Emotional support dogs



(ESAs) These dogs provide comfort and companionship to help alleviate symptoms of mental or emotional disabilities, such as anxiety, depression, or PTSD. 


Unlike service dogs, they are not trained to perform specific tasks and do not have the same broad legal rights to enter all public spaces. 


Key Legal Rights and Restrictions


While they lack the universal access of service animals, ESAs are still protected under certain federal laws: 


  • Housing (Fair Housing Act): Landlords must provide "reasonable accommodations" for ESAs, even in buildings with "no pets" policies. They cannot charge pet deposits or monthly pet fees for these animals.

  • Air Travel: As of early 2021, the U.S. Department of Transportation no longer requires airlines to treat ESAs as service animals. Most airlines now treat them as standard pets, which may involve fees and size restrictions.

  • Public Spaces: ESAs generally do not have the right to enter restaurants, stores, or other businesses that prohibit pets. Access is granted at the discretion of the business owner.




How to Qualify


To legally designate a dog as an emotional support animal, you must:

  1. Have a Diagnosed Disability: A mental or emotional condition that substantially limits at least one major life activity.

  2. Obtain an ESA Letter: This is a formal "prescription" from a licensed mental health professional (e.g., therapist, psychiatrist, or psychologist).

  3. Ensure Document Reliability: HUD cautions that "certificates" or "registrations" purchased from online sites without a direct professional relationship are often not considered reliable documentation. 


Recommended Breeds


While any dog can be an ESA, certain breeds are frequently chosen for their gentle and intuitive temperaments: 


Golden Retriever: Highly sociable, patient, and easy to train.


Labrador Retriever: Renowned for loyalty and sensing their owner's emotions.


Cavalier King Charles Spaniel: Affectionate "lap dogs" ideal for smaller living spaces.


Poodle: Intelligent, hypoallergenic, and available in various sizes (Toy, Miniature, Standard).


Shih TzuCalm, loving, and well-suited for apartment living.
